Cyberlaw Decoded: Current Awareness

Cyberlaw refers to many areas of law involving the use of computers and the Internet.

A "Law of the Horse"?

Is the "Law of Cyberspace" as unnecessary as the fictional "Law of the Horse" as posited by Judge Frank Easterbrook at the University of Chicago in 1996?  It's true that legal issues such as  defamation, obsenity, fraud, property infringement, commerce, regulation and many more exist in real space as well as cyberspace, and neither Internet nor horse will "illuminate the entire law" (Easterbrook, 1996). But that was back when the Internet was just starting to come into its own.  Patricia Bellia states in her Cyberlaw casebook, "The emergence of a global network of interconnected computers able to access, store, process, and transmit vast amounts of information in digital form has already altered our cultural landscape and...these tremendous cultural changes bring with them new legal challenges." (Bellia, Cyberlaw, p.1)
