What case law?

There is no centralized authority of IEL. Foreign decisions, including the UN and its related bodies' resolutions and declarations, may express general environmental law principles and support.

Access to foreign court decisions varies among jurisdictions. Many courts provide jurisprudence on court websites which are searchable (although English translations are rare).

Remember, periodicals are a good source for citations/text of national and international case law.

ELAW (Environmental Law Alliance Worldwide)
ELAW has some court decisions. You can use the ELAW Digest, an annual compilation of importantto see environmental law decisions, or you can search Legal & Scientific Resources (under Resources): select a region, then a country, then review a list of available materials. Coverage varies between countries.

International Tribunal for the Law of the Sea
The Tribunal has jurisdiction over all disputes and all applications submitted to it in accordance with the Convention, over all matters provided for in any other agreement that confers jurisdiction on the Tribunal (Statute, art. 21). The Tribunal deals both with disputes (contentious jurisdiction) and legal questions (advisory jurisdiction) submitted to it.

Oxford Reports in International Law
This database integrates important decisions on public international law from international courts and tribunals, domestic courts and ad hoc tribunals. There are four modules: International Courts of General Jurisdiction, International Human Rights, International Criminal Law, and International Law in Domestic Courts.
